Terms and Conditions ("Terms")

Please read these Terms and Conditions ("Terms", "Terms and Conditions") carefully before using the https://www.seatingplan.com website (the "Service") operated by Mega Seating Plan Ltd ("us", "we", or "our").

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access or use the Service.

By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access the Service.

Data protection

We take data protection very seriously. You agree not to upload sensitive student data. The full data protection policy is available here and the GDPR compliance statement here.

Subscriptions and billing

Mega Seating Plan is offered on a subscription basis. Subscriptions may be monthly, annual or three-yearly and are charged in advance.

Subscriptions automatically renew at the end of each billing period unless cancelled before renewal.

Cancellation

You may cancel your subscription at any time via your subscription management page.

Cancellation will prevent future charges but you will continue to have access to paid features until the end of your current billing period.

Refunds

Except where required by law, subscription fees are non-refundable once access to paid features has begun.

That said, we understand that mistakes and unusual circumstances can happen. In some cases, we may choose to offer a refund or account adjustment as a gesture of goodwill.

Any such refunds are offered at our discretion and are not an entitlement or contractual right. If you believe there has been a genuine error or exceptional circumstance, please contact us and we'll do our best to help.

Consumer cancellation rights

If you are a consumer (that is, you are purchasing as an individual rather than on behalf of a school or organisation), you normally have a legal right to cancel your contract within 14 days of purchase under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.

However, when you purchase a Mega Seating Plan subscription, you agree that access to paid features will begin immediately. By doing so, you acknowledge that you lose your statutory 14-day right to cancel once the service has begun.

This does not affect any statutory rights you may have in relation to faulty or misdescribed services.

Free trials

We may, at our discretion, offer free trials of Mega Seating Plan subscriptions.

During a free trial, you will have access to paid features for a limited period at no charge. The duration of the trial and the features included will be clearly displayed at the time you sign up.

You may cancel a free trial at any time before it ends via your account settings. If you cancel during the trial period, you will not be charged.

Unless you cancel before the end of the trial period, your subscription will automatically convert to a paid subscription and you will be charged the applicable subscription fee at the end of the trial.

When a free trial converts to a paid subscription, the paid subscription is subject to the cancellation and refund terms set out above, including the provisions relating to digital services and consumer cancellation rights.

Business customers

Subscriptions purchased on behalf of a school, trust, or other organisation are business-to-business contracts and are not subject to consumer cancellation rights.

Subscription pauses

We may, at our discretion, allow you to pause your subscription for a limited period. A pause temporarily delays billing but does not cancel your subscription.

While a subscription is paused, access to paid features may be limited or suspended. At the end of the pause period, your subscription will automatically resume and billing will recommence unless you cancel beforehand.

Subscription pauses are subject to availability, limits, and conditions determined by us, and are not a contractual right or entitlement.

Mega Seating Plan Ltd has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party web sites or services. You further acknowledge and agree that Mega Seating Plan Ltd shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such web sites or services.

Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time.
